The agreement of the general assembly of co-owners is required before submitting the prior declaration. Some condominiums have adopted a specifications document specifying the authorized models, colors, and materials. Installing windows without this agreement exposes the co-owner to an obligation to restore at their own expense.
In practice, the request is included in the agenda of the next general assembly. The co-owner provides a technical description and a visual of the proposed model. The wait can last several months if the assembly is not scheduled in the short term.
Sanctions in case of works without prior declaration
Works carried out without a prior declaration constitute an infringement of the urban planning code. The town hall can note the irregularity during the works or after their completion, within a limitation period of six years from completion.
- A report of infringement may be drawn up, leading to prosecution before the judicial court.
- The court may order compliance, which means removing the installed windows and reinstalling the old ones, or regularization by submitting a declaration.
- A fine may be imposed, the amount of which depends on the severity of the infringement and the area concerned.
Subsequent regularization remains possible as long as the installed windows comply with current urban planning rules. The town hall then processes the request as a standard declaration. In a protected area, this regularization is more uncertain as the ABF may refuse the already installed model.
Changing windows remains a technically simple project, but its administrative framework varies greatly depending on the nature of the modifications, the location of the property, and the condominium status. Checking the PLU and consulting the urban planning department of the town hall before any order of joinery remains the most reliable way to avoid a blockage during the work.
